National Anti-Corruption Mechanism (MENAC)
Decree-Law 70/2025, published on 29th April, amends Decree-Law 109-E/2021, which created the National Anti-Corruption Mechanism (MENAC) and established the general framework for the prevention of corruption.
These changes are aimed at streamlining MENAC's functioning and operations, redefining its internal structure and governance model.
In this sense, MENAC's management is now carried out by a collegiate body, the Board of Directors, which has the following competences:
a) Ensure the fulfilment of MENAC's duties;
b) Ensure administrative, financial, asset and human resources management;
c) Approve a four-year strategic plan, an annual activity plan and an annual report, submitting it to the Assembly of the Republic and the Government by 30th April of the following year;
d) Initiate and decide on administrative offence proceedings and impose the respective fines;
e) Appoint the secretary-general of MENAC and terminate their service commission, in accordance with the law;
f) Approve MENAC's internal regulations;
g) Approve MENAC's budget proposal and submit it to the Government within the deadlines set for the drafting of the State Budget bill, and provide the Assembly of the Republic with any information requested on this matter;
h) Ensure the execution of MENAC's budget;
i) Delegate powers to its members and to the secretary-general;
j) Exercising any other competences assigned to it by law or internal regulations.
Additionally, the Advisory Board's role has been extended to include the power to give its opinion on other particularly relevant acts and documents, such as plans and reports to be submitted to the Government. The composition of the Advisory Council now includes all sectoral and regional control bodies, a representative of the President of the Court of Auditors and a representative of non-governmental organisations in the area of research, study and combating corruption and related crime.
The Monitoring and Sanctions Committees are also eliminated and will be replaced by the Planning, Prevention and Information Unit and the Inspection and Administrative Offences Unit, respectively.
The law also provides for the existence of a Single Auditor and establishes the obligation to notify MENAC of dismissals, indictments, acquittals or convictions in relation to corruption offences or related offences.
Decree-Law 70/2025 comes into force on 29th May 2025.
