TOL - LEGAL TEAM (“TOL”) respects your privacy and values the relationship they have with you, subject to strict legal regulations of secrecy and confidentiality, we comply with the General Data Protection Regulation (GDPR) – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April and remaining legislation in place.

This Data Protection and Privacy Policy aims to inform you about the way TOL processes your Personal Data and ensures your privacy in the development and carrying out of its activities.

At TOL we privilege our Clients' privacy, as well as clarity and transparency in our relations with them. Therefore, we inform you, through this Personal Data Treatment Policy, that we collect and process personal data of our Clients, as well as of those involved in the Client's dossiers, in order to fulfil the services requested from us.

TOL reserves the right to modify the present Policy on the treatment of personal data, such modifications being available on TOL's website.

1. Controller of the personal data:

The entity responsible for the processing of your personal data is TOL - LEGAL TEAM, RODRIGUES & NÓBREGA, SOCIEDADE DE ADVOGADOS, SP, RL.

2. What personal data or information we collect:

For the execution of the services we may collect and process personal data provided to us by the Client, from the Client itself or from third parties in connection with the provision of services that has been requested from us and limited to that purpose.

With the express prior consent of the Client or third parties, personal data may be requested in order to send legal or corporate informative communications from TOL to clients and third parties (TOL NEWS, TOL NEWSLETTER or other information "Informative Communications").

3. How we use the collected personal data:

Client personal data is collected and processed primarily because it is necessary in the context of the provision of legal services provided by TOL, for compliance with legal obligations, in particular money laundering prevention legislation and tax obligations, and for the pursuit of TOL's legitimate interests.

The personal data collected and processed for the purpose of Informative Communications are used primarily to manage the system of disseminating communications and information to Clients and Third Parties, on legal information and corporate information of TOL. With regard to personal data collected for the purposes of Informative Communications, the Client or the third party owners of such data may object to the data processing for this purpose at any time and by any means.

4. For how long do we store your data:

The personal data of Clients and third parties related to the provision of services will be kept for the legal period strictly necessary for the fulfillment of contractual and legal obligations.

The personal data collected and processed for the purposes of the Informative Communications shall be kept until the data subject exercises his or her rights to forget, object or limit the processing.

5. Personal data are shared or transmitted to third parties:

The personal data of Clients and third parties in connection with the provision of services will not be passed on to third parties, except where this is necessary to comply with legal obligations.

6. Where personal data are stored:

Information containing personal data will be stored in TOL - LEGAL TEAM's databases.

Personal data will not be transferred outside the European Union Area or European Economic Area.

These databases are on Cloud Providers, which will be located in the European Union Area or European Economic Area.

Given our international nature, in order to provide our services, it may be necessary for us to transfer your personal data to locations outside Portugal.

Therefore, TOL may have to transfer your personal data to a third country outside the European Economic Area and not included in the list of countries which the European Commission has already considered as meeting adequate standards of protection for personal data. In such cases, TOL will ensure that data transfers are carried out in strict compliance with applicable legal standards, in particular Chapter V of the GDPR.

7. Right of access to personal data:

The Client and the holders of personal data are guaranteed the right of access, rectification, opposition, erasure or "right to be forgotten", limitation, withdrawal of consent and portability of their personal data under the applicable legal terms.

The exercise of the respective rights may be requested by e-mail to geral@tol-legal.pt  or by written request sent to Rua Andrade Corvo, nº 29, 1º floor, 1050-008 Lisboa.

Such data may have to be kept, for archival purposes only, if required by Law.

Holders of personal data collected for the purposes of Informative Communications may also object at any time to the use of such personal data for the purposes of Informative Communications, or even demand that such data be removed.

The Client and the holders of personal data collected for the purposes of Informative Communications always have the right to lodge a complaint with the supervisory authority (Comissão Nacional de Proteção de Dados).
